Terms of use

The short version: use Moatly fairly, readings are measurements not advice, and you can cancel any time.

What Moatly is

Moatly reads public evidence about software products and gives two readings: how strong a product's moat is, and how much pressure it's under. The free check gives a reading of any product. Weekly monitoring rebuilds your product's reading every week and tells you what changed. An audit is a deeper review by a person.

Readings are measurements, not advice

Every reading comes from public sources at the time it was taken, and shows how confident it is. Sources can be incomplete or wrong, and something we couldn't check is marked as not checked, never as safe. Use readings as one input to your own judgement, not as financial, legal or investment advice.

Nobody can pay to change a reading. Paying adds time and depth, never a different score.

Using Moatly fairly

Don't try to get around the limits on new reports, overload the service, scrape it, or resell readings as your own product. API keys are for your own use: keep yours private, and tell us if it leaks so we can replace it.

Monitoring: billing and cancelling

Monitoring is a subscription per product, billed in advance each month or year through Stripe, which handles your card details: we never see them. Prices include any VAT that applies.

The founding price is for the first 100 members and stays the same for as long as your subscription continues. If you cancel and come back later, the price at that time applies. We'll give you at least 30 days' notice of any other change to what you pay.

You can cancel any time from your billing page or by emailing us. Monitoring continues to the end of the period you've paid for, and we don't refund part-periods, except where the law gives you a right to one.

If you're buying as a consumer rather than for a business, you have 14 days from subscribing to cancel. If you ask us to start straight away and then cancel within those 14 days, we may keep a fair amount for what we provided before you cancelled.

Audits

Each audit is quoted and agreed before it starts, including what it covers and when you'll get it. Our usual turnaround is 48 hours from the kick-off call.

If something goes wrong

We work hard to keep Moatly running and accurate, but we can't promise it will always be available or error-free. As far as the law allows, our total liability to you is limited to what you paid us in the 12 months before the problem, and we aren't liable for indirect losses such as lost profit. Nothing here limits liability that the law doesn't allow us to limit.

Changes and the law

If we change these terms, we'll update this page and the date above, and tell monitoring customers by email about anything that matters. These terms are governed by the law of England and Wales.
